Terms and Conditions

These Terms and Conditions apply to the use and access of AuCyberscape, the Australian Cyber Network Ltd’s (ABN 85 678 371 189) Australian Cyber Security Capability Digital Platform (Platform) in addition to the Privacy Policy. By using and accessing the Platform, you agree to be bound by these Terms and Conditions.

1. Platform

The purpose of the Platform is to deliver a ‘one-stop-shop’ digital ecosystem for:

  1. Australian cyber security companies to:
    • showcase their cyber security products and services, business solutions and sector experience;
    • connect with their businesses, government, investors and individuals;
    • access information to support their company development and growth.
  2. Customers/users to:
    • understand more about cyber security and their cyber security needs;
    • search for and directly connect with Australian cyber security companies;
    • learn about cyber security career pathways and education opportunities;
    • explore the Australian cyber security sector.

2. Using the Platform

As a condition of using the Platform, you agree to the following:

  1. You will not:
    • use the Platform to defame, abuse, harass, stalk, threaten or otherwise offend any person;
    • publish, distribute, email, transmit or disseminate any material which is unlawful, obscene, defamatory, indecent, offensive or inappropriate
    • publish, distribute, email, transmit or disseminate any material which is ‘sensitive information’ as defined in the Privacy Act 1988 (Cth);
    • engage in or promote any third party surveys, contests, pyramid schemes, chain letters, unsolicited emailing or spamming;
    • impersonate any other person or entity;
    • upload, post, email, transmit or otherwise make available any material that you do not have a right to make available or which contains viruses, or other computer codes, files or programs designed to interrupt, limit or destroy the functionality of other computer software or hardware or to utilise other computer systems for improper purposes or without authorisation;
    • breach any laws or regulations which are applicable to your use of the Platform in your jurisdiction;
    • use the Platform with the intention of procuring supplies for resale;
    • negotiate or execute commercial transactions on the Platform; or
    • suggest or imply in the content you upload that by responding or connecting to your content a transaction will occur or a binding contract will arise.
    • The Platform does not create binding contracts between users of the Platform. Connecting through the Platform does not bind users to any action.
  2. When you supply organisation information on the Platform, that information may be disclosed to other users of the Platform in order to deliver the purpose of the Platform. Personal information will not be disclosed without prior consent.
  3. It is your responsibility to ensure personal and organisation information provided when registering onto the Platform is accurate and kept up to date thereafter.
  4. Australian Cyber Network reserves the right to remove content that contravenes these Terms and Conditions, and refuse access to the Platform to users who contravene these Terms and Conditions.

3. Linked Third-party Websitess

You acknowledge and agree that Australian Cyber Network has no control over the content of any linked third-party websites, or the changes that may occur to the content on those websites. It is your responsibility to make your own decisions about the accuracy, currency, reliability and completeness of information contained in linked third party websites. You are responsible for being aware of which organisation is hosting any linked website that you may visit.

Links to third party websites do not constitute an endorsement or a recommendation of any material on those websites or of any third party products or services offered by, from or through those websites.

4. Personal Information

Australian Cyber Network collects and manages personal information in accordance with the Privacy Act 1988 (Cth). Its Privacy Policy can be found at www.auscybernetwork.au.

5. Exclusion of Warranties and Limitation of Liability

Australian Cyber Network does not provide any warranties in relation to the accuracy, currency, reliability or completeness of any content on the Platform.

Australian Cyber Network is not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with your use of the Platform or any linked third party websites. You must use your own precautions to ensure that the material you access on the Platform is free of viruses or anything else that may interfere with or damage the operations of your computer systems.

Australian Cyber Network accepts no responsibility or liability for any damage, loss, or expense incurred by you or anyone else that arises out of reliance on any content on the Platform. The presence of users and content on the Platform should not be taken to be an endorsement or recommendation of the users or content by Australian Cyber Network. You should make your own independent inquiries and obtain your own independent professional advice prior to relying on, or making any decisions in relation to any content on the Platform. You must undertake your own due diligence prior to entering into any agreement or contract with another user of the Platform. Your use of the Platform does not create a legal relationship between you and Australian Cyber Network.

Australian Cyber Network provides no warranty or representation in relation to the availability of the Platform, and cannot guarantee that the Platform or any third party website linked to the Platform will be free from viruses or anything else that may interfere with or damage the operations of your computer systems.

You should not make commercial decisions on the basis of content presented on the Platform, for example a decision to source or begin manufacturing of a particular product.

6. Changes to Terms and Conditions

Australian Cyber Network may change these Terms and Conditions at any time without notice by publishing new Terms and Conditions.

7. Severability

Any provision of these Terms and Conditions which are unenforceable or partly unenforceable is, where possible, to be severed to the extent necessary to make these Terms and Conditions enforceable.

8. Jurisdiction

The law applicable to the use of the Platform and to these Terms and Conditions is the law of Australian Capital Territory, Australia, and the parties submit to the exclusive jurisdiction of the courts of Australian Capital Territory in relation to any matters arising under these Terms and Conditions, any Additional Terms and Conditions or in relation to the Platform.
